Abstract: The opposition proceeding has been introduced for the first time in Serbian trademark law with the new Trademark Law in 2020. The opposition proceeding has been present in European trademark law for quite some time, although, until recently, member states haven’t been obliged to implement it in their national law systems. Harmonizing its law with European legal traditions, the Republic of Serbia has introduced the opposition proceeding. In the following paper, the author aims to examine the way this legal institute is regulated in other law systems, especially EU law, and compare it with the solution of Serbian law. The author firmly believes that it is necessary to analyze the way in which the harmonization of Serbian trademark law has been conducted and is it in line with our law and the intentions of European legislation.
