Назив: KAZNA GRAĐANSKE SMRTI U ANGLOSAKSONSKOM I FRANCUSKOM KRIVIČNOM PRAVU
Аутори: Marinković, Milica
Датум издавања: 2023
Сажетак: In the paper, the author gives an account of the origin and development of the civil death penalty in Anglo-Saxon and continental law. The author decided to pay attention to the French law as the most representative criminal-legal system in Europe of the 19th century when analyzing the continental variant of this punishment. By analyzing legal texts, court rulings, older and newer literature, the author provides a comparative account of the consequences of civil death in these two most important European and world legal systems, as well as the opinions of supporters and opponents of this punishment. Although on European soil it is considered a punishment belonging to the past, in the Anglo-Saxon legal system civil death is still the subject of a very lively discourse.
