Abstract

The modern legislation of the Republic of Serbia has taken a significant step towards harmonization with the solutions of the European Union in the field of personal data protection. Several years of implementation of the Personal Data Protection Act have already intensified the practice of the competent Commissioner, which is an indicator of still insufficient appreciation and understanding the importance of the need to consistently respect the right to privacy. One of the possibility of avoiding the observance of this right is also the improper application of time dimensions of personal data protection. So in this case too, the time is shown as an important factor that affects and determines the essence of law. In this scientific paper, an effort was made to the time dimension presented through the legal principle of data storage limitations persons with a direct and logical connection with the principle of the purpose of data processing. Both of these principles are linked by the principle of legality in the application processes of collection, processing and storage data. The initial violation of legality logically also affects the final link of custody data, which opens up space for the enrichment of legal practice, both domestic and European. The concluding considerations are aimed at pointing out the necessity of timely and quality education, so that the legal awareness of all entities that deal with data on personalities contributed to legal certainty and the stable position of the right to privacy in society.
