Abstract: The paper analyzes the concept of human rights under the challenges of the COVID19 pandemic. The collision of two principles, the principle of public health on the one hand and human rights on the other, contributed to various interpretations and examples from practice. Accordingly, the space R is observed. Serbia. The way in which human rights are limited by the decisions of the state administration is subject to critical observation. At the same time, the social turmoil and protests that erupted not only in Serbia, but throughout the world, are proof that there was no unified attitude and understanding of the challenging pandemic situation. The views of the European Court of Human Rights are also being observed on that track. In addition to the short period of time, there are already judgments of the ECtHR that can indicate the current positions of the practice.
