Abstract

According to the Serbian Advocacy Law, Advocacy is an independent legal aid service. Professional, conscientious and independent performance of the advocacy profession represents one of the basic guarantees in the realization and protection of human freedoms and rights. Due to the position of the defendant when he is charged with the commission of a criminal offence, the importance of advocacy services is particularly pronounced in criminal proceedings. Therefore, the legal services of the defender represent the main subject of analysis of this paper. The author will first present the positive legal provisions that regulate the status of a lawyer, and then she will deal with the right to defence, from which the defendant's right to defender arises. In the central part of the paper, the author will analyze the role of the defender, considering his position and importance in criminal proceedings.
