In Roman law, liability for damage caused by an animal existed both in the case of domestic animals and in the case of wild and exotic beasts. With regard to dogs, the question of liability and the lawsuit that will be applied, which is the subject of the paper, depended on whether the dog reacted instinctively and caused damage, or whether the damage was caused by the action of the dog, but the harmful behavior is the result of human activity and fault.en_US
