Abstract

The paper analyzes some issues related to litigation in which eviction is discussed and decided (from the perspective of court practice). The proceeding in eviction litigations is initiated by a lawsuit, which represents the plaintiff's request to free the immovable property of persons and things. In other words, the goal of the lawsuit and the proceeding that is being conducted according to this lawsuit is for the defendant to hand over the immovable property emptied of all persons and things to the plaintiff for free use. The paper is based on the positions of court practice in the context of the eviction lawsuit, the parties and adducing of evidence in these civil proceedings.
