Abstract: Taking over employees, as a way of establishing an employment relationship in our legal system, originally arose in the civil service system. However, after that, it started to be regulated in other activities, including education. Taking over employees in education and upbringing institutions is a way of establishing an employment relationship, but also a measure to solve the redundancy of employees. Taking over employees is impossible in all education and upbringing institutions, but only in primary and secondary schools founded by the Republic of Serbia, an autonomous province and local self-government unit. Taking over employees in primary and secondary schools is generally regulated by law, while a separate collective agreement regulates the admission procedure in detail.
