Abstract: In the paper, the author provides a comparative overview of domestic regulations that regulate the issue of searches of apartments and other premises and the case law of the European Court of Human Rights in that domain. By analyzing significant judgments, this paper illustrates the standards for the legal conduct of apartment searches established by the European Court of Human Rights through its rich practice in this domain, as well as the protective measures necessary to protect individuals from arbitrary intrusion. Finally, this paper aims to shed light on the issue of compliance of the domestic legal framework with the framework established in the practice of the European Court of Human Rights.
