The digital environment brings with it new challenges in the realization and protection of fundamental human rights. One of these challenges is related to a key component of the digital space – the internet and the issue of information published on this global network. Once published, data remains accessible to the wider public without time limitation, which can endanger an individual's privacy. Adapting to new challenges, the European Court of Human Rights, established as an independent supranational body, continuously develops its case law concerning the protection of rights. Its judgments provide an important framework for understanding and protecting individual rights in the digital environment, emphasizing the importance of the right to privacy, but also the right to freedom of expression, transmission, and storage of information. The subject of the paper will be the analysis of the case law of the European Court of Human Rights in matters concerning the protection of the “right to be forgotten,” through reaching a balance between opposing rights – the right to privacy and the right to freedom of expression.en_US
