Abstract

The subject of the author's consideration is the neighbor's right to prohibit excessive immissions, as one of the most important neighbor's rights in modern conditions. In the first part of the paper, the author defines the concept and types of immissions, as well as the group of neighbor's rights to which the prohibition of excessive immissions belongs. In the second part of the paper, the author analyzes the criteria based on which the immissions that must be tolerated are distinguished from those whose prohibition can be requested. In the concluding part of the paper, the author suggests how this matter should be regulated by our future regulations.
