Abstract: Тhe notary public institution is one of the most important institutes of modern law which contributes to a greater degree of legal certainty, prevention of disputes, and relief of the courts. With the adoption of the Notaries Act in 2011, public notaries have been introduced into Serbian law. Therefore, this profession gains increasing importance in contemporary legal transactions, and raises a number of controversial issues, since it is a about a new institute in Serbian legal system). One of these issues concerns the legal position of notaries. The legal position of a notary public depends on the type of notary form adopted in a single legal system, on the specificities of that legal system and its legal tradition, as well. In order to answer this question, the paper provides a comparative overview of the forms of organizing the notary service, represented in comparative legal systems and their dominant legal nature, as well as social function, which significantly defines the legal position of notaries.
