Abstract

The issue of mutual relationship between unfair competition and unfair commercial practice has not been solved yet in the legal theory. The subject of this paper is determination of relationship between these two institutions, through the analysis of their elements, forms of appearance, application, etc. The author in the paper, primarily, analyzes the notion and origins of unfair competition and unfair commercial practice, aiming to determine the place and importance of these institutions in contemporary legal system. Afterwards he deals with the mechanisms of application of unfair competition and unfair commercial practice, with special emphasis to the cases in which one and the same act of the trader breaches the rules of both institutions.
