Abstract: Million tonnes of waste are produced in the world every year. Considerable part of that is hazardous waste. It became the important issue, because of his hazardous characteristics and large number of incidents which can happen and can be serious threat to our health and environment quality. Transport of hazardous waste is a complex and highly risk segment of the waste management system. It requires strict and sufficiently coherent legislative framework. Especially cross-border transport of hazardous waste requires not only the strict laws, but permanent control and inspection of the waste movement. Significant differences between tha states in prices for treatment and disposal of hazardous waste, waste treatment capacity and special treatment technology are the reasons that we have the illegal shipment of hazardous waste which provides an example of a complex and serious environmental crime. This work includes analysis of the notion and classification of hazardous waste, legislative framework for cross-border transport of hazardous waste, conditions under which it can be realised and situation in which that transport becomes the illegal.
