Title: ODBAČENE STVARI („RES DERELICTAE“) U RIMSKOM PRAVU
Authors: Tucaković, Saša
Issue Date: 2023
Abstract: The Romans were not inclined to dismiss things lightly, unlike the people in contemporary age, among which it is an everyday occurrence. An abandoned thing exists when it's abandoned by the owner by leaving the possession of the thing with the intention of relinquishing ownership of it (animus derelinquendi). Starting from sources that deny the existence of the abandoned things, in the paper deals with the notion of abandoned things. In addition, special attention is paid to acquiring ownership of abandoned things, in order to determine when they were acquired by occupation (occupatio), when with usucaption (usucapio), and when with transfer to an uncertain persons (traditio incertae personae).
