Abstract: We encounter digital content every day, and we enter into contractual relationships as providers of services, with the rights and obligations arising from that relationship, which define our legal position. The question that arises is the question of the legal fate of digital assets after the death of their owner (user), and the possibility of access to these digital contents by heirs. In order to define an adequate legal framework and models of digital inheritance, and to establish the basic principles of the digital property inheritance system, it is necessary to define the concept of digital property, the types of digital goods, as well as which goods can be inherited and which are non-inheritable.
