Abstract: | The Regulation (EU) 2023/2411 of 18th October 2023 on the protection of geographical indications for craft and industrial products and amending Regulations (EU) 2017/1001 and (EU) 2019/1753, applying since 1st December 2025, establishes a unified EU title for the protection of geographical origin of craft and industrial products. It is prescribed that legal procedure regarding the examination of the applications in order to be established if conditions for registration of geographic indications are fulfilled encompasses two phases, first at national level and second at Union level. Exceptionally a direct registration procedure is possible at the request of the Member State. Unlike the EU designations of geographical origin system protecting agricultural products which is administered by Commission on Union level, the entity in charge at EU level, according to this Regulation, is EU Intellectual Property Office (EUIPO) although Commission retains the power to decide upon the application where registration might be contrary to public policy and when registration of the geographical indication or rejection of application might jeopardize the Union’s trade or external relations. As the form of geographical origin protection for craft and industrial products geographical indication has been chosen but unlike TRIPS Art. 22, it is an absolute legal protection laid down. |
