Abstract: | Although EU legislative policy is the result of a compromise between different (often conflicting) interests, a certain shift towards more sustainable consumption and a circular economy has been made. In order to prevent the differentiation of national rules on repair, some of its aspects are fully harmonized (especially those outside the seller’s liability regime for non-conformity of goods), by introducing a kind of “secondary liability” of the manufacturer. The right to repair, as, generally speaking, more environmentally friendly, is no longer seen only as a legal remedy for the nonconformity of goods, but as a (general) self-standing right. The paper analyzes the main elements of Directive (EU) 2024/1799, which encourage consumers to use purchased goods for a longer period of time and, therefore, strive to reduce the premature discarding of viable goods. |
