Abstract: | To a greater extent, the Republic of Serbia has harmonized its law in the field of intellectual property with the law of the European Union. However, in addition to the harmonization through the obligations established in the directives, member states harmonize their law with the rules contained in the regulations. This is also the case with the design registration, which is not covered by the obligation of harmonization, but most member states have applied deposit system for the design registration which is provided for community design regulation. In the paper that follows, the author tries to examine whether our country should harmonize its law with the law of other European Union countries and apply a deposit system in the design registration, or whether the procedure, which implies a substantial examination, should be retained. By applying the comparative method, the advantages and disadvantages of both systems will be examined, and by applying the legal-dogmatic method, all characteristics of both systems will be examined in detail. The aim of the paper is to give a recommendation regarding whether our country should harmonize its law with the law of other European countries in this domain. |
