Abstract: | The concept of a fresh financial start for entrepreneurs forms the basis of personal insolvency, particularly for entrepreneurs. A crucial aspect of this fresh start is the discharge of debt, which strengthens entrepreneurship and plays a significant role in preventing and resolving economic crises. In Europe, the fresh start principle is associated with an earned start. The European approach to the new financial start for entrepreneurs has evolved through initiatives such as the "second chance" and the development of the Directive on preventive restructuring. This paper will analyze the regulation of debt discharge as a key element of the new financial beginning for entrepreneurs, with a specific focus on European solutions. This analysis is important as European regulations can serve as a model for Serbian legislation. The paper will also examine the current state of debt discharge regulation in Serbian law, particularly the need for regulation of entrepreneurs' insolvency. The author will reference the planning reference of The Draft of the Law of Entrepreneurs' Insolvency in this context. |
