Abstract: Recognizing the importance of digitization and technological innovation for the economic recovery of the country, the Republic of Serbia was among the first European countries to regulate the field of business with digital assets. By defining its concept, types, issuance, trade, as well as services related to digital assets, new business entities were introduced into the legal order of the domestic state. The high risk that accompanies all business related to digital assets, the necessary legal certainty and economic stability have conditioned the normative regulation of the implementation of supervision over the digital market and its subjects. As the legislator envisages two forms of digital assets, virtual currencies and digital tokens, the supervisory powers are also divided between the National Bank of Serbia and the Securities Commission, depending on exactly what type of digital asset is involved. The subject of the work is the analysis of supervision on the digital market and the empowerment of supervisory authorities, with the aim of identifying the most appropriate way to overcome existing and potential problems related to services related to digital assets.
