DIGITALIZACIJA PARNIČNOG POSTUPKA U REPUBLICI SRBIJI

Abstract

This paper analyzes the legal framework and practical challenges of the digitalisation of civil litigation in the Republic of Serbia, with a particular focus on electronic documents, electronic filing, and electronic service of documents. The author highlights the importance of legal and technological infrastructure for the implementation of electronic communication in court proceedings, as well as the necessity of introducing the e-Court platform as a (mandatory or possible) tool for all professional participants, and other as well. The advantages of digitalisation are emphasized, especially in terms of efficiency and access to justice, along with the associated risks such as data security and digital exclusion. The paper concludes that the adoption and implementation of the proposed legislative solutions are key prerequisites for the modernization of the Serbian judiciary in line with European standards.
