Abstract: Adiudicatio in Roman law represents a part of the formula in the inheritance division action (actio familiae erciscundae), the partition of co-ownership action (actio communi dividundo), and the boundary determination action (actio finium regundorum), in which the judge is authorized to award a thing to one of the parties. While Gaius emphasized its procedural aspect within the formulas of inheritance and boundary disputes, Ulpian regarded adiudicatio as one of the modes of acquiring ownership. This paper primarily examines adiudicatio from the perspective of ownership acquisition, highlighting its specificities in different types of disputes.
