Title: RUDARENjE LjUDSKIH PRAVA: MEĐUSOBNI ODNOS PRAVA NA DIGITALNU PISMENOST I REPRODUKTIVNE AUTONOMIJE

Abstract: In a broader sense, the subject of this paper is the process of digital transformation of human rights in the overall process of social transformation. At the level of the European Union, the observed transformation is part of the action 'Europe ready for the digital age' carried out by the European Commission within the broader initiative 'European Digital Decade'. Wider normative frameworks are contained in the acts of the European Union, namely the Act on digital services and fundamental rights (Digital Services Act and fundamental rights issues posed); Instruments for the standardization of artificial intelligence (AI) and its use in accordance with the VI strategy and the Declaration of Digital Principles - the 'European way' for the digital society. More concretely, the research is focused on two issues: the assumed right to digital literacy as well as reproductive autonomy in the digital age, taking into consideration sector-specific norms. The basic premise of the research is that the right to digital literacy and the right to reproductive autonomy in the digital age are essentially connected, potentially in such a way that the existence of the former is a prerequisite for the realization of the latter. As for the first question, we do not address it’s the content and scope, rather we investigate if we need the right to digital literacy at first place. We find that the answer is crucial for the existence of the right itself. Regarding another issue posed, we tried to analyze the way in which digital literacy can affect the enjoyment of reproductive autonomy. In this regard we are taking into account the technological characteristics of the AI system, but also the model according to which existing and future EU legislation approaches the role or capacity of AI in reproductive choice through different stages of reproduction. It is expected that the results of the research will contribute to the process of digital transformation that is carried out in Serbia in accordance with, among other, the Reference Framework of Competences for Democratic Culture as well as national strategies.
